Please read these terms before booking or attending a Sway event.

    To book or attend any event, individuals are required to be at least 18 years of age. It is imperative that by proceeding with a booking, you unequivocally affirm that all the information you have provided, including your full name, age, and contact details, is not only accurate but also complete. This requirement is strictly enforced to ensure compliance with legal standards and to maintain the integrity of the booking process. Any deviation from these stipulations could result in the nullification of the booking and potential legal consequences, underscoring the seriousness with which these conditions must be adhered to.

    The ticket pricing structure is subject to variation based on the specific event type, encompassing categories such as sports, social gatherings, dining experiences, and other activities. For each event, the ticket price is generally set at a standard rate for both men (₹699) and women (₹499), as specified at the time of booking. This amount is subject to variation based on the specifics of the event. It is imperative to note that full payment is required to secure your reservation. With a strict limitation of 30 attendees per event, divided equally between men and women, reservations are processed on a first-come, first-served basis. All bookings must be made through our official website, and a confirmation will be dispatched to your registered email address upon successful completion of the booking process.

    Once a booking is confirmed, it is crucial to comprehend that no refunds will be issued under any circumstances, regardless of the reason for non-attendance. The policy is strictly non-cancellable because maintaining a clearly defined gender ratio is essential for our events. Once attendees have committed, they cannot withdraw from their obligations. If an attendee finds themselves unable to participate, the reserved spot is non-transferable to any alternative event and remains non-refundable. In such cases, it is important to inform us at least four days before the event. However, at your discretion, you may transfer the ticket to another eligible individual, provided you notify us no less than 24 hours in advance.

    By participating in this event, you are expected to adhere to a code of conduct that fosters an atmosphere of respect and courtesy. It is vital to extend kindness and consideration to all attendees, organisers, and venue staff consistently. Harassment, ragging, bullying, insulting, humiliating, or any form of discriminatory behaviour, whether verbal, physical, or otherwise, is categorically forbidden. Your conduct should not jeopardise the safety or comfort of any individual present at the event. Moreover, solicitation in any form is disallowed. This encompasses selling products or services, promoting other businesses, or engaging in any multi level marketing schemes during the event. It is imperative to respect personal boundaries; if someone expresses a desire to not continue a conversation or opts not to exchange contact information, their choice must be honored and deemed final. Lastly, compliance with all reasonable directives provided by the event organizer is anticipated throughout the duration of the event.

    In the event of a breach of this Code of Conduct, the organiser retains the authority to expel any participant from the event forthwith, without the possibility of a refund. This measure is deemed necessary to uphold the integrity and decorum of the event. Moreover, individuals found to be repeat offenders or those whose infractions are deemed egregious will face a permanent prohibition from attending future events. It is noteworthy that the preferred recourse for misconduct is immediate expulsion and a perpetual ban, rather than imposing monetary penalties. This is due to the complexities and legal intricacies associated with enforcing fines in India, which necessitate specific legal drafting to qualify as a liquidated-damages clause.

    In the context of interactions among attendees, privacy and mutual consent are paramount. While the exchange of personal details such as phone numbers, social media information, and photographs is permissible, it is contingent on the express agreement of all parties involved. Attendees must refrain from photographing or recording others without their explicit consent. Furthermore, the dissemination of another attendee's phone number, social media handle, photos, or personal details to individuals not present at the event is strictly prohibited unless explicit permission has been granted by the concerned party. Additionally, utilizing an attendee's contact information for purposes not expressly approved by them is not acceptable. Any breach of these protocols may lead to the immediate expulsion from both current and future events, underscoring the significance of respecting privacy and consent.

Our data privacy practices are meticulously designed to prioritize your privacy while efficiently managing your booking. We collect only essential details, such as your name, phone number, email, and identification for verification when necessary, exclusively to confirm and handle your reservations. Booking confirmations are dispatched via email, ensuring seamless communication. We adhere to a strict data retention policy, storing your personal information only for the duration necessary to facilitate the event, after which it is promptly deleted. Should you choose to book with us again, your details may be retained to expedite future bookings and preserve your attendance history. We categorically do not share your personal data with any third party, including brand partners, for any purpose. By proceeding with a booking, you consent to receiving communications via WhatsApp, SMS, or email for confirmations, event updates, and occasional marketing, with the option to opt out of marketing messages at your discretion.

    The liability waiver outlined by Sway stipulates that participation in all activities, including but not limited to go-karting, board games, and other physical or group endeavours, is entirely voluntary and undertaken at the participant's own risk. Sway shall not be held liable for any injury, loss, theft, or damage to personal property that may occur during or in connection with the event, except in cases where such occurrences result from proven negligence on our part. Furthermore, for physical activities, there may be additional venue-specific waivers that participants are required to sign separately at the venue, such as those at a go karting facility. Participants must also agree to adhere to the venue's individual rules and safety instructions.

    By affirming your participation, you acknowledge the absence of any medical condition that could render your engagement in the forthcoming activity hazardous. In circumstances where uncertainty about your health status arises, it is imperative to seek the counsel of a medical professional before partaking in events that necessitate considerable physical exertion.

    Alcohol and Prohibited Items (Applicable exclusively to events where alcohol is served.) At Sway Company events, the consumption of alcoholic beverages is strictly regulated and permitted only for individuals who have reached the legal drinking age as defined by the jurisdiction where the event takes place. Attendees are strictly prohibited from bringing their own alcoholic beverages or any other prohibited substances into the venue, as this may compromise the safety and enjoyment of all guests. Our staff and the venue's representatives possess full authority to monitor and enforce these rules. They are also authorized to deny service to anyone appearing intoxicated, ensuring the event remains a safe environment for all participants. Should an attendee be deemed excessively intoxicated, we reserve the right to escort them from the premises without any obligation to issue a refund, thereby maintaining the integrity and safety of the event.

    By participating in our events, you agree to indemnify and protect us from any claims, losses, or legal expenses that may arise from your actions, misconduct, or breach of these terms. This means you are responsible for any costs associated with damage or legal issues resulting from such behavior or violations. This clause is crucial to ensure that all participants understand their responsibilities and the potential consequences of their actions during the event.

    Please be aware that our events may be photographed or recorded for promotional purposes, including marketing and social media outreach. By attending, you give your implicit consent for your likeness to be captured and used in these materials. If you prefer not to have your image used, you have the right to opt out. To exercise this right, notify the event organizer in writing before the event begins to ensure your preferences are respected.

    The liability of Sway Company to attendees for any claims related to the event is strictly limited to the amount paid for the event ticket. This limitation is enforced to the fullest extent permitted by law, ensuring that any compensation or claims pursued due to issues arising from the event cannot exceed the ticket's purchase price. This policy is implemented to provide a clear and equitable framework concerning potential liabilities, underscoring the company's commitment to maintaining fairness and transparency in all its dealings. Attendees are advised to understand this limitation as a binding condition of their participation.

    Sway Company reserves the unequivocal right to deny entry or participation to any individual at our sole discretion. This right is exercised under various circumstances, including but not limited to addressing safety concerns, adhering to venue capacity restrictions, or responding to inappropriate behavior. Our foremost priority is to maintain a secure and enjoyable environment for all attendees, and this provision empowers us to uphold these standards diligently.

    In the event of unforeseen circumstances beyond our control, such as the unavailability of the venue, adverse weather conditions, or amendments by brand partners, Sway Company reserves the right to adjust the venue, activity, date, or time of the event. We are committed to informing attendees of any modifications at the earliest possible moment, with the aim to minimize disruption to your plans.

  16. 16

    Sway Company is not liable for any cancellations, delays, or modifications resulting from circumstances beyond our reasonable control. Such events include natural disasters, governmental restrictions, or unavailability of venues. This clause establishes that certain situations are beyond our management, setting clear expectations for attendees in these scenarios..
